We are Genex Capital, an independent buyer of settlement payments. We are not affiliated with Berkshire Hathaway or its structured settlement companies. Program details below were checked in August 2026 against public industry sources; confirm current terms with Berkshire directly.

First: their program, honestly

Berkshire Hathaway's structured settlement group runs a Hardship Exchange Program: if you receive payments from a Berkshire company and you face genuine financial hardship, they may buy back a portion of your payments themselves. Public reporting on the program describes a discount rate around 6.5%, which is significantly better than typical factoring offers. A court still has to approve the transaction, and Berkshire applies its own hardship screen on top of that.

Our honest advice: if you are a Berkshire annuitant and you qualify, apply and get their offer in writing. It may genuinely be the best number available to you, and that advice costs us leads. One thing to know: their program is their own annuity buyback rather than a competing purchase offer, so program quotes sit outside our $1,000 best price guarantee.** What we bring instead is a second written number with the rate disclosed, so you know exactly what qualifying saved you, and a real option if the program says no.

Where their program may not fit

  • You do not meet their hardship screen. Their standard is stricter than the "best interest" test your state court applies. Wanting to pay off debt, buy a home, or start a business may not qualify as hardship, yet a judge can still find a sale in your best interest.
  • Excluded categories. Reporting on the program describes exclusions such as workers' compensation payees and certain trust arrangements. We evaluate those case by case.
  • You want to sell more than the program will take, or on a different schedule. Their program buys what fits their criteria; a competing buyer prices what you actually want to sell.
  • Your payments are not from Berkshire at all. The program only serves their own annuitants. We buy payments from settlements funded by any major issuer.

Just need Berkshire's service desk?

Most people searching for their annuity company are not selling anything: you may need a payment schedule, a benefits letter, or an address change. Public reporting lists the Hardship Exchange Program line at (402) 916-3799, and general servicing contacts are on your policy documents and annual statement. Calling your issuer for service is free and the right move; nothing on this page should stop you.

The clear-eyed sequence for Berkshire annuitants who want cash: 1) Ask Berkshire about the Hardship Exchange and get any offer in writing. 2) Get our free written offer, rate disclosed. 3) Take the better one. If their program approves you at a better rate, take it with our blessing. If it does not, you already have your alternative in hand.

* Cash advance availability, amounts, and timeframes vary based on individual circumstances (typically up to $1,000, within 24 hours of qualifying, where offered). Cash advances are offered and made solely by Genex Capital Corporation at its sole discretion and are subject to its underwriting requirements, including: (1) execution and return of a payment purchase contract and all documents required to begin the purchase process; (2) confirmation that you receive periodic settlement payments; (3) a determination that you may enter into an agreement to sell all or a portion of those payments; (4) a determination that the purchase transaction is likely to receive court approval under applicable state law; and (5) satisfaction of underwriting guidelines. Available only to U.S. citizens or permanent legal residents who have reached the age of majority in their state of residence.

** Genex Capital Corporation will pay you $1,000 if it cannot beat a qualifying offer from another payment purchasing company. To qualify: (1) you must provide a written quote from another payment purchasing company, signed by an authorized representative and dated within three business days of the date you submit it ("Qualifying Quote"); (2) if Genex Capital is unable to beat the Qualifying Quote's purchase price, you will receive written notice within three business days of receipt; and (3) the $1,000 is due and payable upon written confirmation that the transaction funded at the quoted purchase price, and that funding must occur within ninety days after you receive written notice that Genex Capital cannot beat the Qualifying Quote. Quotes issued under an annuity issuer's own buyback or hardship program (including the Berkshire Hathaway Hardship Exchange Program) are not Qualifying Quotes. Limit one offer per customer. Not available where prohibited.

This website is operated by Genex Capital Corporation. All offers to purchase settlement payments, all purchases, and all cash advances are made by Genex Capital Corporation and its affiliated companies (A+ BBB rating). We are not a lender or a law firm, and we do not provide legal, tax, or financial advice; consult independent professionals before selling. Every transfer of settlement payment rights requires approval by a judge under applicable state law, and no transaction is final without that approval. Since 2003, $1.2 billion in payments transacted, 50,000+ clients served, and 95% approval success are figures reported by Genex Capital Corporation.
