What Happens During Court Approval?
Every structured settlement transfer requires court approval under your state's Structured Settlement Protection Act (SSPA). This process protects you by ensuring the transfer is in your best interest.
Here's what the court approval process typically involves:
- Petition filed - We file a petition with the court in your state.
- Waiting period - Most states require a waiting period (typically 20-30 days) before the hearing.
- Independent advice - Some states require you to receive independent professional advice.
- Court hearing - A judge reviews the transfer and confirms it's in your best interest.
- Transfer order - The court issues an order approving the transfer.
- Funds disbursed - We wire your lump sum payment.
