The short version: if you receive periodic payments from a settled case, you can usually sell some or all of them for a lump sum. Every state requires a judge to approve the transfer, which protects you and takes roughly 45-90 days. You do not need your original lawyer, and it costs nothing to find out what your payments are worth.

You can usually sell if...

  • Your case is settled and payments are flowing (or scheduled) from an annuity or similar arrangement
  • You are the payee, and you are an adult (or the court-approved guardian of a minor payee)
  • You have a real reason a judge can find in your best interest: debt, housing, medical bills, a business, education

Where it gets harder

  • Your lawsuit has not settled yet. There is nothing to sell until there is a settlement. (Pre-settlement funding is a different industry, with different risks; we do not offer it.)
  • Workers' comp and certain government payments have extra restrictions that vary by state.
  • A judge has denied a similar request recently. Courts look for a plan, not a pattern.

What the judge actually checks

Your state's Structured Settlement Protection Act requires the court to find the transfer is in your best interest, considering your needs and those of your dependents. The judge sees the full terms, including the discount rate. That is why we put the rate in writing from the first offer: the number gets shown to a judge either way. Do I have to sell everything?

No, and most people should not. Selling a portion of your payments solves the immediate need while the rest of your schedule keeps arriving. Judges approve partial sales more readily, too.
